    Rear End Collision on N.C, 87 Results in Death

    A truck owned by B.W. Wilson Paper Company slammed into the rear of a mini-van driven by Betty Currie Davis as she was turning into her driveway off N. C. Highway 87 near Fayetteville, N. C.  at approximately 2:00 p.m. Monday afternoon, September 29, 2008.

    Mrs. Davis was killed in the wreck. Her sister who was in the passenger seat at the time the mini-van was rear ended was air flighted to UNC Hospital in Chapel Hill where she is in critical condition.

    The driver of the paper truck, John Richard Woodell, was charged with death by vehicle. Woodell lives in Dunn.

    Trooper Ray Battle who investigated the accident said thet Woodell was not speeding but that he was inattentive.

    It does not take a lot of speed to do a lot of damage. This can be seen in the video of the vehicles involved in this tragic wreck. This collision also illustrated the fact that it does not take a lot of speed  to result in tragic death or serious injury. Here, one lady was killed and her sister seriously injured in a wreck that did not involve speed.

    Real end collisions are common. Our office handles hundreds of these cases each year. Here Woodell was clearly negligent and is liable to the family of Mrs. Davis for all damages resulting from her tragic and unnecessary death. He is also liable also to Mrs. Davis' sister for her personal injuries including medical and hospital bills, permanent injury, pain and suffering and any wages or other income she lost.

    Obviously, the amount of this claim is huge. Because the vehicle was owned by W. B. Wilson paper company, the liability insurance policy which covers that vehicle will have to  pay for all damage up to the policy limit. The policy limits are hopefully  very high because the insured vehicle was commercial.

    Aside from its' liability insurance policy, B. W. Wilson Paper Company would also be directly liable to the accident victims if Woodell was working for the paper company at the time of the wreck.

    Hopefully this family will be fully and adequately compensated for their loss. Of course, there is no amount of money that can adequately compensate for the loss of a loved one. However there appears to be  a lot money available for this family.
